Could the best regulation for CBD be… none?


The Farm Bill of 2018 legalized hemp, but since that time confusion has largely ruled the national discussion of its derivative, CBD.


Cannabidiol, or CBD for short, is a compound found in cannabis that offers many of the benefits of marijuana use without the mind-altering high. Regulations have wavered at the state level, while federal regulators at the Food and Drug Administration have yet to lay down a solid foundation on how to treat CBD.


Now, some think that no framework could be the best framework.


In a recent editorial published in Forbes, journalist Kevin Murphy argues that CBD markets should be allowed to work out their own methods of maintaining product quality. [1]


Murphy argues that mechanisms within CBD’s competitive sector to handle the seemingly harmless risks of CBD.


He goes on to point out that CBD products are much more similar to drugstore vitamins and supplements, which are not regulated by the FDA. [1]


“Look at any supplement jar, and you’ll notice a disclaimer saying that the FDA has not evaluated any claims made on the label,” Murphy writes. “The manufacturer is responsible for ensuring the accuracy of claims, not the FDA.”


Part of Murphy’s argument relies on the prospect that as more and more investors eye up the billions of dollars some have appraised for coming years within America’s CBD market, they’ll want stricter assurances of quality. [1]


Third-party labs are one such avenue of quality control. With each batch of products tested thoroughly for terpene content, THC and CBD levels, there’s no reason consumers can’t enjoy the CBD products they rely on safely and easily.


“These investors want to see more evidence in the form of U.S. research on CBD, and yet the ability to do more research is hindered by federal regulations,” Murphy argues in his column. [1]
